Standard Operating Procedures & Rental Terms of Baliqu Car Rental.
Vehicle Rental Agreement
Please read these Terms of Service carefully before booking or renting a vehicle. By placing a reservation, paying a deposit, or taking possession of the vehicle, you agree to comply with all terms and conditions set forth below.
1 Driver Eligibility & Requirements
- Minimum Age: The primary renter and any designated drivers must be at least 18 years of age.
- Driving License:
- For Indonesian Citizens: A valid domestic driver's license (SIM A).
- For Foreign Nationals: A valid home-country driver's license accompanied by a valid International Driving Permit (IDP). A digital copy must be provided during booking.
- Verification: The renter consents to data verification checks through third parties, including banking institutions, local community heads (RT/RW), civil registries, or next of kin, if deemed necessary for security purposes.
- Identification Retention: The renter must present their original KTP/Passport upon vehicle delivery. Baliqu reserves the right to hold a valid physical identity document (e.g. KTP or passport) as additional collateral during the rental period.
- Photo Documentation: The renter agrees to be photographed without facial coverings (glasses, masks) during the hand-over. This documentation remains the property of Baliqu and may be used for security purposes.
2 Payment & Security Deposit
- Full Payment: The remaining rental balance must be paid in full upon delivery/pickup of the vehicle.
- Security Deposit: A mandatory refundable security deposit (amount varies based on vehicle class, e.g., IDR 500,000 for motorbikes and standard cars, and higher for premium fleets) is required.
- Usage of Deposit: The deposit serves as a guarantee against electronic traffic fines (ETLE/E-Tilang), overtime fees, minor cosmetic damages, fuel shortages, interior stains, parking violations, and key losses.
- Deposit Refund: If no violations or damages occur, the security deposit will be refunded in full within 1 to 2 business days after the vehicle is successfully returned.
3 Cancellation & Refund Policy
We offer flexible cancellations, subject to the following windows:
- Standard Cancellation (Full Refund): Cancellations made more than 48 hours prior to the scheduled rental start time will receive a 100% refund of any down payments/advances.
- Late Cancellation: Cancellations made within 24 to 48 hours of the scheduled start time are subject to a 50% cancellation fee of the total rental value.
- Last-Minute Cancellation & No-Show: Cancellations made less than 24 hours before the start time, or failure to show up for delivery, will result in a 100% forfeiture of the rental down payment/booking fee.
- Early Returns: There are no refunds or credits issued for early vehicle returns or unused rental days once the rental agreement has commenced.
4 Damage, Insurance & Renter Liability
- Minor Damage (Scratches/Dents): The renter will be charged a standard flat rate of IDR 500,000 per panel for scratches, scrapes, or minor dents.
- Major Damage / Accident repairs: If the vehicle is involved in a collision causing significant damage, the renter is liable for:
- The actual repair costs at an authorized body shop.
- A Loss of Use fee, calculated as the vehicle's full daily rental rate for every day the vehicle remains in the workshop for repairs.
- Self-Risk Limit (Collision Damage Excess): Renters may opt for our standard Collision Damage Waiver (CDW) which limits the maximum renter liability (deductible) to IDR 3,000,000 per incident for major accidental damage, provided they report the event immediately and did not violate any rental policies.
- Total Loss / Theft: In the event of a total write-off or theft of the vehicle, the renter is fully responsible for replacing the vehicle with a unit of the exact same make, model, and year, or paying the equivalent market value in cash.
- Roadside Assistance & Negligence: Mechanical failures not caused by driver behavior are covered by Baliqu. However, towing, recovery, or tire repair costs arising from driver negligence (e.g., leaving headlights on resulting in a dead battery, running out of fuel, off-road driving, or flat tires from sharp objects) are fully payable by the renter.
5 Fuel, Cleaning & Overtime Policies
- Fuel Policy (Same-to-Same): The vehicle is delivered with a documented fuel level (e.g., half tank, full tank) and must be returned with the same fuel level. If returned with less fuel, the renter will be charged IDR 75,000 per missing grid/bar on the fuel gauge.
- Strict Smoking Ban: Smoking of any kind (including e-cigarettes/vapes) is strictly prohibited inside the vehicle. A violation of this policy will incur a mandatory **IDR 1,000,000 professional detailing and deodorization fine**.
- Interior Cleanliness: Renters must return the vehicle's interior in a reasonably clean state. Stains, food spills, mud, or pet hair will result in a professional interior cleaning fee ranging from IDR 200,000 to IDR 1,000,000 depending on severity.
- Overtime Rate: If you return the vehicle late, an overtime charge of 10% of the daily rental rate per hour (minimum IDR 50,000/hour) applies for up to 3 hours. Returns delayed by more than 3 hours will be automatically billed as a full additional day.
6 Strict Prohibitions & Legal Action
- Geographic Boundary: Vehicles are permitted for use strictly within the Province of Bali. Taking the vehicle outside the main island of Bali (e.g., crossing to Lombok, Nusa Penida, or Java) by ferry or any other means is strictly prohibited.
- Subleasing & Pawning: The renter is prohibited from selling, pawning, duplicate keying, subleasing, or pledging the vehicle as collateral. Any attempt to do so is a criminal offense.
- Mechanical Modifications: The renter must not modify, dismantle, repair, or replace any parts, machinery, or accessories without explicit, written authorization from Baliqu management.
- Criminal Use: The vehicle must not be used for any illegal activities, including transporting drugs, carrying out thefts, smuggling, or committing any other infractions under the Criminal Code of Indonesia.
- Loss of Keys: Loss of vehicle keys, transponders, or keyless entry remotes will incur a replacement and programming charge ranging from IDR 1,500,000 to IDR 3,500,000 (depending on the vehicle model).
- Enforcement & Prosecution: In case of breaches (including failure to return the vehicle on time without extension approval), Baliqu reserves the right to track and recover the vehicle forcibly via GPS, confiscate the security deposit, and immediately initiate criminal prosecution under Articles 372 (Embezzlement), 378 (Fraud), 480 (Fencing), and 55-56 of the Indonesian Criminal Code (KUHP).
Limitations of Liability
- Lost Property: Baliqu Car Rental is not liable for any personal belongings, cash, electronics, or valuables left behind or lost inside the vehicle during or after the rental period.
- Delays & Road Mishaps: Traffic jams, punctures, weather events, or accidents resulting in travel delays, missed flights, or interrupted itineraries are the sole risk of the renter. Baliqu will not issue refunds or compensations for such occurrences.
